Hubavet Telehealth Services

This Client Disclosure Agreement is between pet owners/legal guardians and Hubavet Inc., facilitating remote veterinary consultations through the Hubavet app.

1. Purpose of Telehealth Services

Hubavet offers a platform connecting clients with licensed veterinarians remotely for informational purposes and does not substitute for in-person veterinary care.

2. Definitions

  • 2.1 Telehealth: Electronic delivery of veterinary services via real-time video/audio, two-way communication, and data transmission.
  • 2.2 Veterinarian-Client-Patient Relationship (VCPR): Requires veterinarian responsibility for medical judgments, sufficient patient knowledge through examination (in-person or real-time video), treatment communication, and cannot be established through audio-only communication or questionnaires.
  • 2.3 Confidential Veterinarian Information: Protected information concerning animals, clients, and veterinary care under California law.
  • 2.4 Synchronous: Real-time interaction between client/patient and a distant licensed veterinarian.

3. Veterinarian's Professional Responsibilities

  • The veterinarian determines if in-person attention is needed.
  • The veterinarian must follow California Business & Professions Code regulations.
  • The client consents to the veterinarian's medical judgment and responsibility.
  • Clients may choose an in-person visit at any time.
  • The client is informed of the veterinarian's identity, licensure, and security measures.
  • Legal liability relates to the patient's location and the veterinarian's jurisdiction.
  • Emergency situations permit telehealth without an already-established VCPR.

4. Limitations of Telehealth Services and Prescribing

4.1–4.2: Telehealth consultations have limitations; unavailability of a physical examination may impact diagnostic accuracy. These services do not replace an in-person examination.

4.3: Legal requirements apply to California-licensed veterinarians serving California clients.

4.4 Prescription Limitations:

  • General drugs: a maximum 6-month prescription period.
  • Antimicrobial/antibiotics: a maximum of 14 days; further prescriptions require an in-person exam.
  • Controlled substances/xylazine: require an in-person examination or an on-site premises visit.
  • The veterinarian notifies clients of pharmacy availability and submits prescriptions upon request.
  • Racing horses: no telehealth prescriptions, per California Horse Racing Board jurisdiction.

4.5: Medical records are maintained where the veterinarian is licensed and are protected from unauthorized access.

5. Protection of Confidential Veterinary Information

5.1: Privacy laws apply to telehealth. Information stays confidential except for treatment, education, billing, and veterinary care operations. Clients consent to information being shared with necessary third parties, including animal images.

5.2: Internet-based communication carries a risk of security breach. Systems incorporate network and software security protocols to protect data integrity. Equipment operators may access information.

5.3: Telehealth sessions may experience technical disruptions affecting communication quality.

5.4: Clients release Hubavet from liability for data loss or information loss resulting from technical failures.

6. Client Responsibilities

  • Provide accurate health information.
  • Seek in-person veterinary attention when advised.
  • Understand that withdrawing consent does not affect future care benefits.

7. Liability Waiver

7.1–7.2: Clients waive claims against Hubavet regarding malpractice, negligence, or other professional misconduct. The waiver extends to third-party claims arising from veterinarian actions or advice.

8. Governing Law

This Agreement is governed by California law. Client acknowledgment constitutes informed consent and becomes part of the animal's veterinary record.
